It’s an inseparable part of these Terms of Use, ensuring your journey with us is not just awesome but also secure and private. 

We can’t promise that Our Platform, or the fantastic content within, will always be at your beck and call without a hiccup. Permission to dive into Our Platform is more like a temporary pass. We might hit pause, pull back, or even change up any part of Our Platform without prior notice. We’re not taking responsibility for any reasons that might render Our Platform unavailable at certain times or periods.

You are only permitted to use our Platform for lawful purposes according to the law. You shall not use Our Platform:

1. In ways that violate local, national, and international laws and regulations;
2. In ways that are unlawful, deceptive, or have intentions or consequences that are unlawful or deceptive;
3. For the purpose of harming or attempting to harm minors in any way;

5. To distribute or send unwanted or unauthorized advertising or promotional materials, including forms of solicitation such as spam;
6. Intentionally forwarding data, sending, or uploading materials that contain viruses, trojans, worms, logic bombs, keystroke loggers, spyware, adware, or other harmful programs or computer code designed to adversely affect the operation of any software or hardware.

You also agree:

1. Not to reproduce, duplicate, copy, or sell any part of Our Platform that contradicts the provisions in Our Platform Use Agreement;
2. Not to access without authorization, interfere with, damage, or disrupt:
a. Any part of Our Platform;
b. The equipment or networks where Our Platform is stored;
c. Any software used in the provision of Our Platform;
d. Equipment, networks, or software owned by any third party.

If you are a public official or state administrator, in using Our Platform, you agree to comply with specific legal regulations, particularly those governing the acceptance of gratuities and other applicable provisions within your institutional environment.

If you are an educator or educational professional, in using Our Platform, you agree to comply with regulations related to the management and implementation of education, especially concerning activities related to the socialization, marketing, distribution, or sale of programs/products from Our Platform to students in the formal educational unit where you teach or work with compensation in any form.

Our platform, including but not limited to names, logos, program code, designs, trademarks, technology, databases, processes, and business models, is protected by copyright, trademarks, patents, and other intellectual property rights available under the laws of the Republic of Indonesia, registered in our name. We hold all rights and interests in the platform, including all intellectual property rights related to all features contained within it.

You may download extracts from specific pages of our platform for your personal use during your subscription period.

You are not allowed to:

1. Copy, modify, print, adapt, translate, create derivative works from, distribute, license, sell, transfer, publicly display, publicly perform, duplicate, transmit, or broadcast in any form or by any means any part of our platform, including but not limited to paid content and materials on the platform, whether physically or digitally, during or after the subscription period.

2. License, sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially exploit our platform and/or any associated software in any manner.

3. Create internet links to our website, or frame or mirror any software on servers or wireless devices connected to the internet.

4. Reverse engineer or access our platform to (a) build competitive products or services, (b) build products based on ideas, features, functions, or graphics similar to our platform, or (c) copy ideas, features, functions, or graphics from our platform.

5. Launch automated programs or scripts, including but not limited to web spiders, web crawlers, web robots, web ants, web indexers, bots, viruses, worms, or any programs that may increase server requests per second or create a load that disrupts the operation and/or performance of our platform.

6. Use robots, spiders, search or site retrieval applications, or other manual or automated processes to retrieve, index, mine data, or duplicate or circumvent the navigation structure or display of our platform or its content.

7. Post, distribute, or duplicate in any way materials with copyright, trademark, or other ownership information without obtaining prior approval from the owner of the ownership rights.

You may not delete copyright, trademark, or other ownership notices contained in our platform. No license or rights are granted to you implicitly or otherwise based on the intellectual property owned or controlled by us and our licensors, except for the licenses and rights expressly granted in these Terms of Use. You may not use any part of the content on our platform for commercial purposes without obtaining a license from us or our licensors beforehand.

You are not allowed to:

1. Send spam or unwanted duplicate messages that violate applicable regulations.

2. Send or store disruptive, indecent, threatening, defamatory, or unlawful materials.

3. Send materials containing software viruses such as worms and trojans, as well as harmful code, digital files, script code, agents, or other computer programs.

4. Disrupt the integrity or performance of our platform and the data loaded into it.

5. Attempt to gain unauthorized access to our platform or related systems and networks.

6. Impersonate individuals or entities that do not reflect your true affiliation.

Our status (and the status of other contributors we have identified) as the authors of content on our website must always be acknowledged.

If you print, copy, or download any part of our platform that violates these Terms of Use, your right to use our platform will be terminated immediately, and you must, at our discretion, return or destroy copies of the material you have created.

We reserve the right to investigate and prosecute any violations of these Terms of Use in accordance with applicable laws. We may involve and cooperate with authorities in prosecuting users who violate these Terms of Use. You acknowledge that we are not obligated to monitor your access to our platform, but we have the right to do so to operate our platform, ensure your compliance with these Terms of Use, or comply with applicable laws or decisions of the court, administrative agencies, or other government bodies.

You may utilize features enabling you to upload content or material to Our Platform or engage with other users of Our Platform through interactive services (hereinafter referred to as “Content”).

Content must be:

1. Accurate (where stating facts).
2. Genuinely intended (where stating opinions).
3. Compliant with the applicable laws in Indonesia and the country from which it is authored.

Content must not:

1. Contain material that defames someone’s character.
2. Contain indecent, offensive, hateful, or inciting material.
3. Promote content related to gambling, lotteries, and/or betting.
4. Promote explicitly sexual material.
5. Promote violence.
6. Promote discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
7. Promote hacking or cracking services.
8. Promote access to fraudulent products, money laundering, multi-level marketing schemes, and pirated products.
9. Promote access to human trafficking and human organ trade.
10. Promote access to illegal substances and narcotics.
11. Promote access to tobacco and tobacco-related materials.
12. Promote illegal sales of products requiring licenses (such as drugs, explosives, firearms, etc.).
13. Infringe on copyrights, database rights, or trademarks of others.
14. Be deceptive to anyone.
15. Be created in violation of any legal obligations to third parties, such as contractual obligations or confidentiality obligations.
16. Promote any illegal activities.
17. Threaten, abuse, or infringe on the privacy of others, or cause unnecessary disruption, discomfort, or anxiety.
18. Be harassing, offensive, embarrassing, worrisome, or disturbing to anyone.
19. Be used to impersonate another person, or to falsify your identity or affiliation with another person.
20. Give the impression that the Content originates from Us when it is not true.
21. Advocate, promote, or assist in actions that violate the law such as (only as an example) copyright infringement or computer misuse.

You guarantee that the Content complies with the mentioned standards, and you will be fully responsible to Us and indemnify Us for any breaches of such warranties. Thus, you will be responsible for any losses or damages suffered by Us due to a breach of your warranties.

All Content you upload to Our Platform will be considered non-confidential, non-proprietary, and not infringing on the intellectual property rights of any party, unless you state otherwise to Us as described in Our Privacy Policy. You retain all ownership rights to your Content, but you are required to grant Us and other users of Our Platform a limited license to use, store, and copy the Content, as well as to distribute and make it available to third parties.

We also reserve the right to disclose your identity to any third party claiming that the Content you display or upload is a violation of their intellectual property rights or privacy rights.

We are not responsible or liable to any third party for the Content or the accuracy of any Content that you or other users of Our Platform post.

We reserve the right to remove any Content you create on Our Platform if, in Our opinion, your content does not comply with the content standards set out in Our Terms of Use.

The views expressed by other users on Our Platform do not represent Our views or values.

You are fully responsible for securing and backing up your Content.

From time to time, we may provide interactive services on our Platform, including but not limited to Chat Rooms, Q&A Forums (hereinafter referred to as “interactive services”).

In situations where we offer interactive services, we will provide clear information to you about the types of services offered.

We will make our best efforts to assess the potential risks for users (especially those under the age of 18) from third parties when they use the interactive services available on our Platform. However, we are not obligated to oversee, monitor, or moderate any interactive services on our Platform, and we expressly exclude our liability for any loss or damage that may arise from the use of interactive services by users contravening our content standards.

Your use of our interactive services, if you are under the age of 18, is subject to the supervision and approval of your parents or legal guardians. We encourage parents who supervise and allow their children to use interactive services to communicate about the online safety of their children. Parents or guardians of users under the age of 18 who use interactive services should be aware of the potential risks you may encounter on these services and take full responsibility for all your actions.

If you encounter any content on our Platform that you believe infringes any copyright, violates other rights, damages reputation, is pornographic or indecent, racist, or in any way causes widespread violation, or constitutes identity theft, misuse, spam, or otherwise violates the Terms of Use, Privacy Policy, and other Applicable Regulations, please report it to us via email at (info@edunesia.net) and/or by mail to the following address: InkubatorX, Jl. Ensure that you include, in the report (“Report”), the following information:

1. A statement that you have identified the content that violates or breaches the Terms of Use and Privacy Policy of our Platform, as well as other Applicable Regulations on our Platform.

2. A description of the violation or illegal content and the link where the content is located.

3. Screenshots of the violating or illegal content.

4. Your full name, address, and telephone number, the email address where you can be contacted, and your Account username if you have one.

By making the Report, you will be deemed to have included, in the Report:

1. A statement that you, in good faith, believe that the use of the disputed material is not authorized by the copyright owner, its agent, or the law.

2. A statement that the information in the Report is accurate.

3. In cases where you report content that you believe infringes copyright or other related rights, a statement that you are authorized to act on behalf of the copyright owner or other rights that are alleged to have been violated.

If we become aware of or have reasonable grounds to suspect that you have engaged in indecent, violating, criminal, or other actions contrary to these Terms of Use and/or applicable laws, whether referenced in these Terms of Use or not, we reserve the right to and may freeze the Account, either temporarily or permanently, or terminate your access to the Platform, conduct an investigation, seek compensation, report to authorities, and/or take other actions that we deem necessary, including criminal and civil legal actions.

We will follow up by conducting an investigation and/or facilitating the relevant Service Provider to report to the authorities if we receive a Report of any violations you commit against these Terms of Use or violations of applicable laws, in connection with verbal abuse or violence, including but not limited to, physical, gender, ethnic, religious, and racial aspects.

You may create links to our Platform, provided that you do so fairly and legally, and do not damage our reputation or derive any benefit from it.

You are not allowed to create links in a way that suggests an association, approval, or endorsement from us when it does not exist.

You are not permitted to link to our Platform on any website that is not owned by you.

We reserve the right to revoke link creation permission without notice.

The website you link to must comply with all aspects of the content standards established through our Terms of Use.

Where our Platform contains links and access to websites and content provided by Third Parties, we have no control over the content of those websites or resources. We are not responsible for any portion of the content provided by Third Parties. Your access or use of such Third-Party content constitutes your agreement to be bound by the Terms of Use and privacy policies set forth by those Third Parties.

You are fully responsible for the decisions you make to use or access the Platform. You must behave respectfully and must not engage in unauthorized, threatening, or abusive behavior or actions when using the Platform.

You are fully responsible for any loss and/or claim arising from the use of the Platform through your Account, whether by you or another party using your Account, in a manner contrary to these Terms of Use, the Privacy Policy, or applicable laws, including but not limited to, for the purposes of anti-money laundering, counter-terrorism financing, criminal activities, any form of fraud (including but not limited to phishing and/or social engineering activities), infringement of intellectual property rights, and/or any other activities that may harm the public and/or any other party or that may or may be deemed to damage our reputation.

We do not guarantee that our Platform will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programs, and platforms used to access our Platform. You must use your own antivirus software.

The platform we provide is as is, and we do not state or guarantee that the reliability, timeliness, quality, suitability, availability, accuracy, completeness, or security of the platform can meet your needs and will meet your expectations.

We are not responsible to any user for loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

•  the use or inability to use our platform; or
•  the use of or reliance on any content displayed on our platform.

We are not responsible for loss or damage caused by viruses, Distributed Denial of Service (DDoS) attacks, or other harmful technological material that may infect computer equipment, computer programs, data, or other proprietary material due to your use or downloading of any content from our platform or any other websites linked to it.

We are not obligated to monitor your access or use of the platform. However, we will continue to monitor to ensure the smooth use of the platform and to ensure your compliance with these Terms of Use, applicable laws, court decisions, and/or the provisions of administrative institutions or other government bodies.

We are not responsible for the content of websites linked to our platform. Such links should not be interpreted as our endorsement of those sites. We are not responsible for any loss or damage arising from your use of those websites.

Our platform may be interrupted by events beyond our authority or control (“Force Majeure”), including but not limited to natural disasters, power outages, telecommunication disruptions, government policies, and others. You agree to release us from any claims and liabilities if we are unable to facilitate services, including fulfilling instructions you provide through the platform, in whole or in part, due to a Force Majeure event.

These Terms of Use are governed by the laws of the Republic of Indonesia. Any and all disputes arising from the use of the Platform are subject to the exclusive jurisdiction of the District Court (Jakarta Timur).

You understand and agree that these Terms of Use constitute an electronic agreement, and your action of pressing the ‘register’ button when opening an Account or the ‘login’ button when accessing your Account is your active consent to be bound by an agreement with us. Therefore, the validity of these Terms of Use and the Privacy Policy is legal and binding and continues to be effective throughout your use of the Platform.

We may modify these Terms of Use from time to time, and any changes will be notified to you in any form and through any means, including but not limited to email notifications. You agree that you are responsible for periodically reviewing these Terms of Use. Your continued use of the services provided in the Platform after changes and/or additions to the applicable Terms of Use will be deemed as your acceptance of those changes and/or additions. You may raise objections to changes and/or additions to the applicable Terms of Use that are considered commercially and materially detrimental to you within 14 (fourteen) calendar days from the date such changes and/or additions are published. We reserve the right to terminate your access to the Platform if you object to the applicable changes and/or additions to the Terms of Use.

We may update the Platform from time to time and change its content at any time. However, it should be noted that the Platform may have content that is not updated from time to time, and we are not responsible for updating it. We do not guarantee that the Platform, or its content, is entirely free from errors or omissions.

You will not make any claims or objections regarding the validity of the Terms of Use or the Privacy Policy made in electronic form.

You may not assign your rights under these Terms of Use without our prior written consent. However, we may assign our rights under these Terms of Use to any third party at any time without needing your prior consent or providing prior notice to you.

If you fail to comply with or violate the terms of these Terms of Use, and we do not take direct action, it does not mean that we waive our right to take necessary action later.

These terms remain valid even after temporary freezing, permanent freezing, or the deletion of the Platform or after the termination of this agreement between you and us.

If any provision of these Terms of Use is deemed unenforceable, it will not affect the other provisions.
